     Anthony Hardeman is accused of killing 26-year-old Demetrius Simpson.

    Today the state presented a witness who was dating one of Hardeman's cousins at the time of the shooting.

    He told the jury he knew Simpson and recalled a fight between Hardeman and another man in which Simpson stepped in and somehow injured Hardeman.

    The witness testified that the day before the shooting Hardeman told him he was going to kill Simpson.

    Investigators say Simpson was gunned down in the 700 block of Marconi in September of 2006.

    The witness also testified Hardeman told him he shot Simpson.

    Investigators say Hardeman's brother and a third man were involved in the shooting.

    Their cases have not gone to trial.

    "Typically it's the policy of the district attorney's office to try the individual that actually killed the person first before you try the co-defendants under party liability because it helps you judge how much to give those other people who didn't actually pull the trigger or stab the person,” says Maureen Shelton Wichita County First Assistant Criminal District Attorney.

    Hardeman and his brother were arrested by U.S. Marshals in Oklahoma City after tear gas was used to end a standoff.

    Investigators say they went there following the shooting and Anthony Hardeman wasn't brought back here until July 2008 because of other charges.

    Hardeman's lawyers will present their case tomorrow morning.
