Montague County sheriff's deputies arrest an elderly man for possession of marijuana, but they say this was the second time he's been arrested on the same charge in the past few months.

That man is 71 year old Paul Bates of Lake Nocona Estates.

Officials say deputies recently executed a search warrant at his home for stolen property and found Nascar memorabilia, along with 1.2 pounds of marijuana.

Bates was arrested and charged with possession of marijuana and delivery of marijuana and officials say more charges are pending.

Tonight, Bates is out of jail after posting a $9,300 bond.
