Army Vets Injured in Midland Crash File Lawsuit

Two army veterans and their wives have filed a civil suit against the train company involved in the deadly accident in Midland.

The lawsuit claims Union Pacific failed to comply with federal and state standards of care in regards to railroad safety. Four veterans died and 17 others were injured in the November 15th collision involving a train and a flatbed trailer.

The driver of the flatbed was carrying the veterans and their wives to a parade organized to honor wounded veterans. A Union Pacific train hit the flatbed as it was crossing the tracks.

The National Safety Board previously determined the train gave the necessary 20 second warning before it reached the railroad crossing.

But one of the plaintiffs' attorney says Texas Department of Transportation told him that particular crossing required a 30 second warning. The company who hired the driver of the flatbed trailer is also named in the lawsuit.
