Colonel was injured Saturday when he and his owner, Al Phillips, came out of the house as officer Brandon Pettigrew was writing Phillips a parking ticket.
According to a lawsuit filed by Phillips, the dog ran past him and Pettigrew fired twice. The Phillips family is seeking in excess of fifty thousand dollars in the lawsuit.
"Those slugs could have ricocheted and hit anyone in the neighborhood to me it's totally irresponsible," said Al Phillips.
Morgan Phillips, his daughter, said, "It's excessive force really and it's unfortunate because I have a lot of respect for the Chicago Police Department and this is horrible."
A police spokesperson says the independent police review authority is looking into the matter and that the officer remains on the job.
