Graves Capital Murder Trial Tentatively Set

By: Melissa Foy
Updated: January 24, 2013
A tentative court date is scheduled for one of the teenagers charged in the murder of a Wichita Falls convenience store owner just over a year ago.
Michael Shay Graves is charged with capital murder in the attempted robbery and shooting of Wichita Falls grocery owner "Mo" Ahmad last year.
Clifton John Russell IV is also charged in his murder.
Graves' case could go to court Nov. 5.
And Russell's case will most likely be set in September or October.
Attorneys are waiting for the U.S. Supreme Court to determine an appropriate range of punishment in this case because Russell, who's the alleged shooter, was 17 at the time of Mo's murder.
Attorneys say if found guilty, Graves' punishment would likely be less than Russell's, so they requested Graves' trial be set after Russell's.
