Trial is set for a man authorities say tried to break into a Wichita Falls home while wearing only his underwear.
Stephen Turner is charged with burglary of a habitation with intention to committ another felony.
Prosecutors are trying to prove Turner was entering the home with the intent of committing a sexual assault.
Defense attorneys say that is not the case.
Authorities say the incident occurred Halloween night in 2011.
Sheriff David Duke told us Turner tried to enter a child's bedroom window at a home off Elmwood.
The mother, an off-duty county detention officer, hurried to their bedroom after hearing glass breaking.
Sheriff Duke says the officer got her gun, told Turner to stop several times, and when he wouldn't comply, Duke says the officer fired one shot at Turner, narrowly missing his head.
Turner told police he suffers from epilepsy, and thought he was having a dream.
He's also charged with aggravated assault against a public servant in an unrelated incident at the Wichita County Jail.
On Nov. 10, 2011, a deputy was reportedly checking on Turner in his solitary confinement cell.
The deputy said Turner asked what time it was.
When he looked down at his watch and looked back up, the deputy says Turner stabbed him in his right eye with a pencil.
Turner is expected to go to trial on at least one of the charges in July.
